The courts specifically avoided answering that question and avoided answering it because the case hinged on the G36 delivering the performance as requested in initial adoption process. The initial adoption requirements did not place the G36 in a position to experience the issues that it experienced. The rifle could explode and kill the operator after shooting 300rds in 2 minutes and the courts would have sided with HK since shooting 300rds in 2 minutes wasn't a requirement.
