    >Plaintiff [Iron Bar Holdings] has a right to exclusive control, use, and enjoyment of its Property, which includes the airspace at the corner, above the Property
Why is this an argument? You don't own the airspace on your property; nobody ever has and nobody ever will. The FAA owns the airspace of every square inch of the US.

Anything can be an argument if you're drinking buddies with the judge

Seems like this is a cut and dry case where the state should require an easement

look up corner crossings or listen to the podcast. I think they're the second "group" that comes in so you might need to skip forward a little although the first guys story was pretty entertaining as well

I really hope that the homosexual bringing the lawsuit gets his anus expanded in federal court and that it sets a precedent unambiguously allowing corner crossings onto all public lands.

      pretty much this.
not allowing corner crossing, and buying up land adjacent to public/BLM land is beyond shitty.

it's one thing if you're a smallholder and it's your private residence or whatever; but these lodges/guide outfits are taking advantage of a loophole and depriving the public.

tl;dr; acting against the public good by denying the public access to something that by definition belongs to them, you should be hanged.

In the podcast they do say they were just dudes who wanted to hunt. They are from out of state. Missouri boomers, Rinella asked them if they intended on being these Rosa Parks style dudes and they were like no we just wanted to hunt and looked up public land online

yea; it's a bunch of bullshit. shows the power of money though. Typically you need to be able to show harm -- some damage must have occurred for there to be any kind of liability.
In this case it makes about as much sense as a farmer suing you for damages over your home garden. By growing your own tomatoes, you are taking money directly out of the farmers pocket; and that's theft!

there's no real harm, just a shitty c**t using the courts to protect his 'revenue stream', while simultaneously stealing public lands from the public.

oh the irony.. and amazingly they're doing this while keeping a straight face.

A lot of large cattle ranchers are complete shitheels who get a hard-on at the thought of having de facto ownership of vast tracts of ostensibly public lands and many of them run guiding businesses on the side.

I need someone to explain to me what a corner crossing is

Imagine a checkerboard pattern where UL and LR are black and UR and LL are white. Black is public land and white is private or otherwise inaccessible to hunters and other outdoorsmen, often as part of a grazing lease. To go from black to black without crossing any part of a white square you have to cross at a corner, but because we're discussing geometry here the actual intersection is arbitrarily small and therefore you have to pass over some portion of the white square (private land) to go from black to black. The people crying about corner crossings are saying that because hunters have to pass through a few square feet of "their" land (which, again, is often a grazing lease and not land they actually own) at the corners to go from public land to public land they're trespassing. If it sounds fricking moronic, that's because it is. They're deliberately abusing a legal loophole to deprive the public of access to public lands and because pissing off ranchers is often a political death sentence in western states nobody has done shit about it beyond pass a few memos.

Public land leasers close off property illegally all the time. It’s annoying as frick.

Holy shit, that sounds really moronic yeah. Who the hell comes up with that shit?

In my country as long as you don't step on someones crop you can walk wherever the frick you want.

                >Who the hell comes up with that shit?
It's a legal loophole. Lots of western states have very old and very strict laws about trespassing (especially regarding hunting and animal husbandry) and they're being abused by the people who have the financial and political capital to keep the loopholes open.

Seems to me just from casual observation this rich shithead purposely leased/bought land in a calculated manner to cut off access to a massive piece of designated public land, then as a business venture they sell access to land they don't own but no one has any way to get to supposedly without their permission. And they know they're doing it, this is all on purpose. County Attorney sounds comped as frick.

                Yep.

                >County Attorney sounds comped as frick.
In areas where there are more cows than people, political careers live and die by the good graces of the local cattlemen.

It's too early to say, because the issue in question is exactly what rules there are and what these rules mean.
