                it effectively states that any rifled weapon with a barrel shorter than 16" with a surface attached to the rear of the weapon (not critical to operation of the gun) which is capable of being shouldered is an SBR.
                the exact definitions of how much surface area, what defines "able to be shouldered", and other caveats like having a weight similar to other rifles, and having a LOP similar to other rifles, and having a scope with eye relief "requiring the weapon to be shouldered", and the marketing of the weapon either from the manufacturer or by anyone else, and how anyone demonstrates the use of the weapon.

                those factors are involved in whether or not the weapon is an SBR, and evidently is entirely up to the discretion of the ATF to determine to what extent each one matters.

    In a county where people can buy fully automatic combat rifles, what matter if a pistol has a brace or a stock or whatever? Is this some tax or legal definition thing? I just don't get what it's all about.

      Its a big deal now because back in 2012 the ATF said yea these are fine and today in 2022 if you even have one with a weapon you can attach it to that constitutes constructive possession and worth a felony, 10 years in jail, etc.
      So the congressional research committee acknowledges that there are like 7 million of these things in circulation and at the same time the ATF has said that they wouldn't invest any significant amount of time or effort into collecting them or processing SBR applications or anything about enforcing the law.

          You're trying to apply a more logical approach to this issue than they want.
          The ATF cared because of various political meddling over the years.
          The ATF doesn't care about the gun mechanism in any real capacity. The only thing the ATF really cares about is enforcing what is effectively a very draconian law in some obtuse way. This is regardless of any context, intent, or ideas before that.
          The ATF and the government as a whole is known for reneging on so many tings but this is arguably the worst because its the most black and white example of them going back on previous statements.
          At one time they said it was absolutely OK to have and use these things regardless of how you used them
          And all of a sudden, granted after years of hints that they were going to do this, they say that they aren't legal at all.

              This was pawned off onto them.
              Congress doesn't want to touch gun law directly. Its politically fraught and does few people any favors in terms of staying bland enough to stay in power.
              So instead the ATF was given next to free rein to dictate much of American gun law. They can't simply ban certain firearms or attachments, but they can recategorize them to require registration and then claiming ownership is criminal without it. As well as set up unclear and vague guidelines for this.

              That banning 'high capacity' mags was not legal because they were common place.
              Seems similar, however it depends on whether a 'ban' is interpreted as different to a 'recategorization'.
              Braces aren't 'banned' technically. Just most guns with them are now categorized as being NFA non-compliant.

      US Gun Law requires you to get a forum to register your rifle and pay a tax to own a rifle with a barrel that is under 16".
      However, it does not have such rules about owning pistols that have barrels under 16".
      Now, AR-15 and other semi-automatic weapons without stocks have long been categorized as pistols. So you could own a stockless AR15 with a barrel below 16" without registration or a tax.

      Pistol braces were developed as a means initially of allowing people with disabilities to one-handedly shoot rifles by bracing it against their arm.
      Putting one on your gun still let it be categorized as a pistol.
      People started buying these pistol braces that were ultimately 'good enough' as stock replacements and fitting them onto pistol configured intermediate rifles as a means of getting below that limit. As having a short carbine is useful for home defense, for example.

      The ATF for some time allowed that to stand. Almost a decade.
      But now has decided to start cracking down on the practice heavily.
      Given the widespread of the use of those braces, this is certainly problematic for a lot of people on both sides.

      it's not about the pistol brace. it's about a regulatory body saying "it's fine. this is fine, you can make and sell these and shoulder them and it's fine" for 10 years. and now, after (by their estimates) 3-7 million are in circulation, they say "actually no, all of those are short barreled rifles, and you can either send in your fingerprints and register the gun, or you can destroy it, or you can become a felon. you have two months to comply."

      note: "register" means that you can no longer freely sell the weapon to anyone, it has to be "transferred" which costs 200$ every time it is sold to anyone. no one is allowed to use it without you being physically present. you have to obtain permission from the ATF by submitting a request if you ever want to bring the firearm over state lines, for any reason.

      congress declared that rifles shorter than 16" are dangerous and unusual, and in order to own one you must register it and pay a 200$ tax, or you face a 10,000$ fine and 10 years in prison.

    I never liked my pistol brace in the first place, shit was annoying and uncomfortable to shoulder. I just took the extra stock laying around in my closet and threw it on my "8.5in pistol". Don't care about the atf, or the tax stamps. It's all fake and gay.
