Its just an accessory and not considered a firearm on its own. The brace might be NFA item if it loses in court. Otherwise, its considered a SBR in this config.

If you intend on you using it in any context, you may have to register it as a SBR. This is pending pistol brace rulings.

does that get rid of the registration needed for the SBR though if they fail to infringe further upon 2a in court?
If the new pistol brace rule gets struck down in court, then this config is no longer a SBR and still just a pistol.
