    Design patents.
    PSA or anybody can make a direct copy of any gun that is old enough where all the parents on it are expired, which only last ~20 years.
    Although most of what the SCAR consists of has existed longer, there are what are called "design patents" which covers the exact design and configuration for the parts used. You could make a copy of the gun that kinda looks like it and functions the same way, but having it exactly the same with interchangeable parts to the original could result in a lawsuit.

      If it's PSA price levels for something fun and different why not? I'd get the .308 but I wouldn't judge someone for the 5.56. Getting a PSA AK is fine and those are more expensive
