how come if you bought a solvent trap, you had to destroy the solvent trap because it was a suppressor and you didn't register it before buying it;
but if you bought a braced ar-15, which is an SBR, you don't have to destroy the illegal SBR even though you didn't register it before buying it?

how come you can register the SBR after the fact, but you couldn't register the silencer after the fact, even though they are both NFA violations and the same class 3 firearms and covered by the same 200$ tax stamp?

Because solvent traps were shit excuses for suppressors and legitimately a niche thing that very few people had any real use for, much like bump stocks.

But now that there are upwards of 10 million pistol braces out there, the ATF can't just order everyone to destroy them (not to say they wouldn't just outright say that if they thought they could). So instead they hope to sound like they're being magnanimous and meeting people half way by saying "okay so you still need to register it, but we'll give you amnesty for not doing it sooner"

not even "just-as-good". exactly as good. and you could get them cheaper, and faster, because form 1s went through quicker than form 4s for a while. building it yourself you could get a suppressor as effective as any top tier form 4 can, for 400 something bucks pre-stamp.

Where can I still get a solvent trap that would be legal to buy then register as a suppressor before assembling?

      Anonymous

that sounds somewhat arbitrary. why would how small of a minority is affected have anything to do with the type of treatment they get for the same "crime"?

        Anonymous

Because if 100,000 outraged citizens write their senators to demand your organization is disbanded, that's one thing. If tens of millions do it that's another. No shit it's arbitrary, they're doing what they assume they can get away with based on the scale of the outrage they figure they'll cause. Ever notice how indians have it way worse than black people but you never hear about reparations for them? Hint: it's because there's way more black people around to complain.

Yea, that's how governments work bro lmao. Kinda seems like they stepped in it this time. Not sure how many senators are going to like hearing "oh yea your phones are blowing up because we decided to make our own laws and turn 10 million of your constituents into felons over night".

Yeah how does that work? Can I just put a regular stock on the gun after getting the free tax stamp approved? Couldn't folks just submit the stamp based on measurements without even owning a brace?

              Anonymous

The ATF's FAQ section for this new rule does say you are ok to take your free tax stamp braced-pistol "SBR" and then replace the brace with a stock. If it changes the OAL you have to notify them.

dude the statement came out yesterday, it's all conjecture. i'm sure you could. who would know? you've got two months. you could buy a brace or buy a 3d printer and make one in that time if you absolutely need to.

This is what I'm thinking. But it depends on the wording of the amnesty.
              >Admit to owning/creating an illegal SBR
              >Here's a free tax stamp
If it's a legit conversion to SBR, ok. If you have to admit committing a crime for a free stamp, frick no.

Considering how long it takes to get a suppressor approved normally, wouldn't this effectively block any new suppressors/SBRs for years and years?
i mean there are 3 million total NFA items registered going back to 1934. considering the estimated 10-40 million pistol braces in the US, i don't see how they could be done in a timely manner.
i do think it is interesting that they say it's okay to have your "unregistered SBR" so long as the paperwork is pending, which isn't the case for other NFA items. if you buy a suppressor, you have to wait until the paperwork is done before you can possess it. if you want to have an SBR at any other point in time than right now, you have to wait to be approved before you could put the stock on your rifle.

Arguably I'd say that it's a good thing to enforce it to the letter and eliminate loopholes.
After reading through the entire comment/response paper, it does make sense. It's moronic to be upset at the ATF for how they are enforcing it. They are exercising the power they are bestowed with. "Doing their job", as required to by Congress, who rubber-stamped the NFA.
"short-barreled rifles are among firearms historically considered by Congress to be unusual and dangerous, the agency is required to implement the NFA and ensure that firearms are properly classified and regulated."
Probably it's smarter to not be upset at the ones enforcing the rule, but at the ones who made the rule. You shouldn't have to jump through hoops to not be a felon- it shouldn't be a felony to begin with.

        Anonymous

They're NOT following the letter of the law. The NFA defines a rifle as "a firearm designed to be fired from the shoulder". DESIGNED TO BE. Not can be. Not overwhelming is. But a question of design intent alone. It's stupid to have a law based on intent instead of action, but that's how the NFA is written.
