Even if the guy didn't go to the ATF they were breaking the law (once a receiver is a machine gun it always is per the ATF). Open bolt is okay in SMGs because the trigger only has to fight the relatively weak recoil spring (still worse than a hammer spring), and the bolt is light enough to hold steady when it slams forward.
If the AA12 has a bolt and spring like the USAS, then the open bolt trigger must be horrible. You can't carry enough drums to cook off a shotgun anyway, and leaving it cocked allows dirt in the chamber.
